Acceptance and scope

These terms govern access to and use of the See Local Music website, applications, content, and related services, collectively called the “Service.” By accessing or using the Service, you agree to these terms. If you do not agree, do not use the Service.

These terms apply to visitors, registered users, and members. If you create or manage an artist or venue account, the Artist and Venue Member Agreement also applies. If that agreement conflicts with these terms concerning member features, the Artist and Venue Member Agreement controls solely with respect to those features.

Our Privacy Policy, when published through the Service, describes how we collect, use, and protect personal information.

Eligibility

You must be legally capable of agreeing to these terms. If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent or legal guardian.

The Service is not directed to children under 13. Children under 13 may not create an account or submit personal information through the Service.

Purpose of the Service

See Local Music is a discovery and information platform that helps people find artists, venues, and live-music events.

Unless expressly stated otherwise, See Local Music is not an artist representative, booking agent, talent buyer, event organizer, promoter, venue operator, ticket seller, transportation provider, employer, insurer, or party to arrangements between artists, venues, organizers, attendees, or other third parties.

The appearance of an artist, venue, event, or business on the Service does not constitute an endorsement, recommendation, background check, or guarantee by See Local Music.

Discovered and managed listings

We may use automated tools, search providers, third-party services, and publicly available sources to discover potential live-music events and create basic event, artist, or venue listings. Discovery does not guarantee that a listing will be created, displayed, retained, complete, or accurate.

Discovered information may be delayed, incomplete, duplicated, incorrectly attributed, or wrong. An event may be omitted even when public information about it exists. A discovered event is not a verified listing, including when it is associated with an otherwise verified artist or venue.

Listings entered and maintained through an authorized artist or venue account may be identified as verified listings. That label means the event was provided or managed through the Service rather than discovered automatically. It does not guarantee that the event will occur or that every detail remains accurate.

Artists, venues, organizers, and authorized representatives may contact us to request a correction, removal, or profile claim. We may require information reasonably necessary to evaluate the request.

Information shown through the Service

Information may be submitted, imported, combined, or updated by artists, venues, organizers, members, third-party services, publicly available sources, or other sources.

This information may include event details, artist and venue names, descriptions, images, videos, audio, genres, addresses, maps, distances, prices, ticket links, age restrictions, food information, accessibility information, membership or verification indicators, and other content.

See Local Music does not guarantee that information is complete, current, accurate, authentic, or free from errors. We are not responsible for incorrect, outdated, incomplete, misleading, duplicated, unavailable, or improperly attributed information displayed through the Service.

Multiple sources may provide information about the same artist, venue, or event. We may combine duplicate listings, standardize formatting, and correct apparent typographical errors. These activities do not make us responsible for independently verifying the information.

A listing that remains visible does not guarantee that an event will take place. A change or cancellation reported elsewhere may not immediately appear through the Service.

Maps and location information

Maps, directions, distances, travel times, and geographic results may be approximate or provided by third parties. They may be affected by device settings, traffic, road conditions, closures, or data errors.

Do not rely on the Service for emergency navigation, precise geographic measurements, or safety-critical directions.

Third-party services and embedded videos

The Service may contain links to or integrations with venues, artists, maps, ticket sellers, payment processors, social networks, streaming platforms, advertisers, sponsors, and other third-party services.

Artist members may submit links to videos hosted by third-party services such as YouTube or Vimeo. See Local Music does not host those videos or claim ownership of them. The member submitting a link is responsible for confirming that they are authorized to share it and that the video, including any music, performance, images, and other included material, may be embedded through the Service.

Third parties operate under their own terms and privacy practices. See Local Music does not control and is not responsible for their content, availability, security, pricing, transactions, fulfillment, cancellations, or refunds. A link or integration does not imply that we endorse or guarantee the third party. We may remove or disable a link or embed in response to a rights-holder complaint, suspected infringement, a provider restriction, or another legal or operational concern.

Tickets, travel, and purchases

Unless expressly stated otherwise, See Local Music does not sell, issue, transfer, or fulfill tickets and is not a party to transactions between you and a third party.

You are responsible for reviewing the seller’s terms, fees, delivery policies, cancellation policies, and refund policies before completing a purchase.

To the extent permitted by law, See Local Music is not responsible for ticket costs, service fees, travel expenses, lodging expenses, lost time, lost wages, or other losses arising from inaccurate information, schedule changes, event cancellations, third-party conduct, or transactions with third parties.

Ownership of the Service

The Service, including its design, software, code, databases, organization, branding, graphics, and original content, is owned by See Local Music or its licensors and is protected by intellectual-property and other laws.

Subject to these terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Service for lawful personal discovery purposes. Artist and venue members may additionally use the Service for purposes allowed by the Artist and Venue Member Agreement.

Except as expressly permitted, you may not reproduce, distribute, sell, license, modify, publicly display, create derivative works from, reverse engineer, or commercially exploit any part of the Service. Nothing in these terms grants you ownership of See Local Music’s names, logos, trademarks, domain names, or other branding.

User-submitted content

Account holders may submit profiles, event information, photographs, artwork, logos, captions, links, and other content. When uploading an image, the account holder confirms that they own it or have permission to upload and display it through the Service.

User-submitted content is the responsibility of the person who submits it. Rights, permissions, licenses, and account responsibilities relating to artist or venue content are governed by the Artist and Venue Member Agreement.

We do not verify ownership of every submission. We may remove or restrict content that we reasonably believe violates these terms, another person’s rights, applicable law, or the safety and integrity of the Service.

Acceptable use

You may not:

• Use the Service for unlawful, fraudulent, deceptive, threatening, abusive, harassing, or discriminatory purposes.
• Impersonate another person, artist, venue, business, or organization.
• Misrepresent your identity, affiliation, authority, location, event, or availability.
• Submit malicious code, harmful files, spam, or deceptive links.
• Attempt unauthorized access to an account, system, network, or nonpublic information.
• Interfere with, overload, damage, disable, or disrupt the Service.
• Circumvent access controls, rate limits, security features, or technical restrictions.
• Scrape, harvest, index, copy, or extract Service data through automated means without our written permission, except as permitted by applicable law.
• Collect, disclose, sell, or misuse another person’s personal information.
• Use information from the Service to send unsolicited commercial messages.
• Infringe copyright, trademark, privacy, publicity, or other rights.
• Use the Service or its data to build or support a competing directory, database, product, or service without our written permission.

Copyright complaints

If you believe content available through the Service infringes your copyright, send a written notice containing your physical or electronic signature; identification of the copyrighted work; identification and location of the allegedly infringing material; your name and contact information; a statement that you have a good-faith belief that the use is unauthorized; and a statement, made under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner.

Submit copyright notices through our contact page. We may remove or restrict disputed material and notify the submitting member. We may terminate accounts of repeat infringers when appropriate. Submitting a knowingly false infringement notice may result in legal liability. Information about counter-notices and restoration requests is available through the same contact method.

Feedback

If you provide suggestions, ideas, or feedback concerning the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation to you. This does not give us ownership of content submitted for an artist, venue, or event profile.

Privacy

Our collection and use of personal information are governed by the Privacy Policy published through the Service. You agree that we may send notices about your account, these terms, security, and the operation of the Service electronically, including by email or through the Service.

Suspension and termination

We may restrict, suspend, or terminate access to the Service when we reasonably believe a user has violated these terms, created legal or security risk, interfered with the Service, or harmed another person.

You may stop using the Service at any time. Sections that by their nature should continue after termination will survive, including ownership provisions, disclaimers, liability limitations, and dispute provisions.

Service availability and changes

We may add, modify, suspend, or discontinue features or portions of the Service. We do not guarantee that the Service or any particular feature, listing, or content will always be available.

We are not responsible for interruptions, delays, transmission errors, data loss, security incidents outside our reasonable control, or failures caused by third-party providers.

Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” See Local Music disclaims all express and implied warranties, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, noninfringement, and security.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that information obtained through the Service will produce any particular result. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, See Local Music and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or business.

We are not responsible for personal injury, property damage, member conduct, event conditions, cancellations, travel, third-party transactions, or reliance on information supplied by members or other sources, except to the extent excluding such liability is prohibited by law.

To the fullest extent permitted by law, our total liability for all claims arising from or relating to the Service will not exceed the greater of the amount you paid directly to See Local Music during the 12 months before the event giving rise to the claim or one hundred dollars.

These limitations apply regardless of the legal theory asserted and even if we were advised that damages were possible. Nothing in these terms limits liability that cannot legally be excluded or limited.

Changes to these terms

We may update these terms by publishing a revised version and changing the “Last updated” date. When changes are material, we may provide additional notice or require registered users and members to accept the revised terms. Changes apply prospectively from their effective date.

Governing law and disputes

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules.

Unless applicable law requires otherwise, any lawsuit arising from these terms or the Service must be brought in the state or federal courts serving Wake County, North Carolina. You and See Local Music consent to the jurisdiction and venue of those courts.

Before filing a claim, you agree to contact us and make a reasonable good-faith effort to resolve the dispute informally.

General terms

These terms, together with any applicable supplemental agreements and policies, constitute the entire agreement between you and See Local Music concerning the Service.

If part of these terms is found unenforceable, the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign your rights or obligations under these terms without our written permission. We may assign these terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service.

Headings are provided for convenience and do not affect interpretation.
